
A company that focuses on the restoration of ancient architecture and the inheritance of intangible cultural heritage construction techniques has long faced the dilemma of difficult protection of core skills and vague definition of innovative achievements. The enterprise possesses six national level intangible cultural heritage techniques, including "traditional wooden mortise and tenon technology" and "ancient architectural painting restoration technology". In recent years, it has developed innovative achievements such as "modern material and traditional craftsmanship combined restoration technology" based on traditional techniques. However, due to the lack of a systematic intellectual property protection system, the core parameters of the techniques have been repeatedly obtained by peers, and three innovative technologies have been imitated, resulting in the enterprise losing bids in multiple key cultural relic restoration projects, with direct economic losses exceeding 6 million yuan.
After conducting in-depth research on enterprises, we found that there are three core issues: unclear boundaries for the protection of intangible cultural heritage skills as "traditional knowledge", unclear ownership of intellectual property rights for technological innovation achievements, and a lack of confidentiality mechanisms in the process of technological inheritance. In response to these issues, we have developed a "three-dimensional protection plan for intellectual property rights of intangible cultural heritage skills" to achieve the coordinated development of traditional skills protection and the transformation of innovative achievements.
At the level of traditional skill protection, assist enterprises in grading and sorting intangible cultural heritage skills, protect 20 core skill parameters such as core mortise and tenon structure diagrams and color painting pigment formulas through trade secret forms, establish a three-level confidentiality system of "skill inheritor enterprise confidentiality agreement", record standardized videos for the skill process, and fix protection evidence through copyright registration. At the same time, for innovative improvements in craftsmanship, such as "seismic resistant traditional wooden nodes", a patent protection path is planned to assist enterprises in applying for 6 invention patents and 8 utility model patents, clarifying the boundary between traditional craftsmanship and innovative achievements.
To promote the market-oriented application of skills, we assist enterprises in establishing an "Intangible Cultural Heritage Skills Intellectual Property Operation Platform", which achieves value transformation through skills authorization, joint research and development, and other means. In a certain world cultural heritage restoration project, the enterprise successfully won the bid with clear intellectual property certification and a sound technical protection system. During the project implementation, patented technology was used to solve the seismic problems of traditional wooden buildings. At the same time, traditional painted patterns were applied to cultural and creative product development through copyright licensing, resulting in an additional income of 3.5 million yuan.
In addition, we also assist enterprises in formulating the "Regulations on the Management of Intellectual Property Rights for the Inheritance of Intangible Cultural Heritage Skills", clarifying the ownership of rights, confidentiality obligations, and achievement sharing mechanisms in master apprentice inheritance. This not only ensures the continuity of skill inheritance, but also stimulates the innovation enthusiasm of inheritors. After one year of project implementation, there have been zero incidents of infringement of the company's core skills, and the conversion rate of innovative achievements has increased by 50%. The company has successfully won four national level cultural relic restoration projects with a total contract amount of 180 million yuan, becoming a benchmark enterprise for intellectual property protection in the field of ancient architecture protection.
