
A certain construction group is facing severe intellectual property risk challenges when undertaking a key highway project in a Southeast Asian country. This project adopts Chinese standard design and construction, involving multiple core technology outputs such as bridge construction technology and intelligent transportation systems. However, the enterprise is not familiar with the local intellectual property legal environment, and there are risks of technology output infringement and self owned brand being registered. If not handled properly, it may lead to project obstruction or even face litigation.
We have formed a multinational service team consisting of international intellectual property experts, engineering and technical consultants, and local law firms to carry out full process intellectual property risk management. Firstly, a patent risk assessment was conducted on the 132 technologies involved in the project. By searching the local patent database, it was found that 8 of the core construction technologies had prior patents in the local area, posing a risk of infringement. In response to this issue, we have developed an avoidance design plan, made adaptive improvements to the technology, and assisted enterprises in submitting six patent applications for improved technologies locally, forming a new technological protection barrier.
In terms of brand protection, it was found that the core trademark of the company has been maliciously registered by local enterprises. We immediately initiated the trademark opposition procedure, collected evidence of prior use of the enterprise trademark and proof of market awareness, and cooperated with local law firms to conduct legal defenses. Eventually, we successfully revoked the malicious registration of the trademark and assisted the enterprise in completing the registration and protection of its core trademark in the local area, including three forms of Chinese, English, and local languages, covering eight related categories such as Class 37 construction services and Class 12 transportation vehicles.
To ensure the smooth implementation of the project, we provide the "Overseas Project Intellectual Property Compliance Manual" for enterprises, covering technology usage authorization, employee confidentiality agreements, partner intellectual property terms, and conduct two special training sessions for the project team. During the bidding stage of the project, the "Intellectual Property Risk Assessment Report" we issued became an important material recognized by the owner, helping the enterprise successfully win the bid for the project with a total amount of 1.26 billion US dollars.
During the implementation of the project, no intellectual property disputes occurred, and the company's technology and brand were effectively protected. This case has become a model for Chinese construction companies to "go global" in intellectual property risk management. Subsequently, we assisted the company in establishing an intellectual property protection system in infrastructure projects in three Southeast Asian countries, providing support for the company's overseas business expansion.
