
A provincial-level architectural design and research institute has long faced problems of plagiarism in design results and difficulties in copyright protection. The institute has core advantages in the design of large public buildings and cultural venues, but its awareness of copyright protection for design schemes, construction drawings, and other achievements is weak. It has not established a standardized copyright registration and management system, resulting in six design infringement disputes in the past three years, with an average protection period of 14 months and direct economic losses exceeding 8 million yuan.
After our intervention, we first conducted a comprehensive diagnosis of the copyright management status of the design institute and found three major problems: unclear division of copyright ownership, insufficient evidence retention during the creative process, and lagging response to infringement monitoring. We have developed a "full process copyright management system construction plan" to address these pain points, achieving closed-loop management from achievement creation, rights registration to rights protection operation.
At the level of institutional construction, assist the design institute in revising the "Management Measures for Copyright of Design Results", clarify the ownership of copyright for different types of design results - the copyright of job-related works belongs to the unit, and establish a system for designer creation files. Through blockchain technology, the entire creative process of design sketches, revision records, etc. can be fully documented. At the level of rights protection, the design institute has been guided to register copyright for more than 300 core design achievements in the past five years, including 12 landmark architectural designs that have obtained work registration certificates, and has applied for appearance design patents for 5 highly original designs, forming a dual protection of "copyright+patent".
To enhance our ability to respond to infringement, we have built a design achievement infringement monitoring platform that uses image recognition technology to monitor bidding websites, competitor websites, and other channels in real-time. In a bidding process for a key cultural center project, the system found that the design proposal submitted by a certain enterprise was highly similar to the previously undisclosed bidding proposal of the institute. We immediately assisted in fixing the evidence, initiated a rights protection procedure, and ultimately the other party withdrew the infringing proposal. The design institute successfully won the bid for the 120 million yuan project.
After a year of system construction, the incidence of copyright infringement disputes in the institute has decreased by 75%, the protection period has been shortened to less than 6 months, and the market value of design results has significantly increased. Through copyright licensing, cooperative development and other means, an additional income of 5.6 million yuan has been added, and copyright management has become one of the core competitiveness of the design institute.
